Texas Penal Code §21.08 generally defines indecent exposure as exposing the anus or any part of the genitals with intent to arouse or gratify the sexual desire of any person while acting recklessly about whether another person is present who will be offended or alarmed. Recklessness means consciously disregarding a substantial and unjustifiable risk. Exposure alone doesn’t establish every element of the offense.
