What “Aggravated DWI” Means Under Texas Law
Texas doesn’t use “aggravated DWI” as a formal charge name. The term describes a standard DWI under Texas Penal Code Section 49.04 elevated by one or more specific factors. Which factor applies to your case determines the offense level, the penalty range, and the right defense approach.
The most common aggravating factors and their consequences:
- BAC of 0.15% or higher: Elevates a first-offense DWI from a Class B misdemeanor to a Class A misdemeanor, carrying up to one year in jail and a fine up to $4,000.
- Child passenger under age 15: A state jail felony regardless of BAC, with a sentence range of 180 days to 2 years in a state jail facility and a fine up to $10,000.
- Intoxication assault (causing serious bodily injury while intoxicated): A Third-Degree Felony under Section 49.07, punishable by 2 to 10 years in prison and a fine up to $10,000.
- Intoxication manslaughter (causing a death while intoxicated): A Second-Degree Felony under Section 49.08, carrying 2 to 20 years in prison and a fine up to $10,000.
- Third or subsequent DWI offense: Automatically a Third-Degree Felony, with the same 2-to-10-year range and a fine up to $10,000.
Penalties extend past imprisonment and fines. A conviction can result in driver’s license suspension of up to two years, mandatory ignition interlock device (IID) installation, mandatory civil fines assessed at conviction, and, for felony convictions, the permanent loss of the right to own a firearm. Felony DWI convictions generally can’t be expunged. That relief is available only for dismissals, acquittals, or pardons.
One diversion path worth knowing: the Midland County DWI Court Program is a structured, minimum 11-month program for eligible non-violent defendants assessed as high-risk. It isn’t available to everyone, but for qualifying individuals it offers an alternative to a straight conviction.
